Terms of Sale

These terms govern the sale of personalized songs offered by [company name] through the Micantara website. Any order constitutes unreserved acceptance of these terms.

The customer fills in a questionnaire describing the recipient of the song and their story. Based on this information, Micantara produces an original song: written lyrics and a recorded performance.

The lyrics and the performance are produced using artificial intelligence tools, under human supervision. The customer is informed of this before any order, on the home page as well as in this article. The result is a generated work, not the recording of a specifically identified performing artist.

The questionnaire and the receipt of a 30-second excerpt are free of charge and carry no obligation. No payment card details are requested at this stage.

The price of the complete song is $29.90, shown on the listening page before any payment. Prices are expressed in US dollars (USD).

Payments are processed by Shopify. Micantara does not retain any payment card data.

The excerpt is sent by email within 4 days from the validation of the questionnaire. This time frame is indicative and does not include delays attributable to an incorrect email address.

One revision request is included. It must be submitted within 14 days following delivery, to contact@mecantara.io, specifying the elements to be changed. A revision covers an adjustment of the lyrics or the performance, not a complete change of project.

In accordance with article L221-28, 13° of the French Consumer Code, the right of withdrawal cannot be exercised for the supply of digital content not provided on a tangible medium where performance has begun after the consumer's prior express consent and express waiver of their right of withdrawal.

By validating their payment, the customer expressly requests the immediate performance of the service and acknowledges that they waive their fourteen-day right of withdrawal. As the song is personalized at their request, the exclusion provided for in the 3° of the same article also applies.

Independently of article 6, Micantara grants, as a commercial gesture, a full refund upon simple request sent to contact@mecantara.io within 30 days following the purchase. This guarantee is a voluntary commitment, distinct from the statutory guarantees of conformity and against hidden defects, which remain applicable.

The customer holds a personal, private and non-commercial right of use over the delivered song: listening, sharing within a private circle, backup copy. Any commercial exploitation, publishing on a streaming platform or advertising use requires prior written agreement.

The customer warrants that they have the right to share the personal information they provide about the recipient of the song.

Micantara reserves the right to refuse any order whose content is defamatory, hateful, threatening, of a sexual nature involving minors, or infringes the rights of third parties. Where applicable, the order is cancelled and refunded in full.

These terms are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action. The consumer may refer, free of charge, to the mediator mentioned in the legal notice or to the European online dispute resolution platform.
